AGREEMENT BETWEEN USER AND ENTERPRISE RETIREMENT LIVING LIMITED (“ERL”)

By using this website and any social media pages belonging to ERL (collectively and individually referred to as the “Site”), you confirm that you accept these Terms of Use without modification and agree to comply with them. If you do not agree to these Terms of Use, you must not use the Site.

SUSPENSION OR WITHDRAWAL OF THE SITE

The Site is made available free of charge. ERL does not guarantee that the Site, or any content on it, will always be available or uninterrupted. ERL may suspend or withdraw or restrict the availability of all or any part of the Site for business and operational reasons.

PERSONAL AND NON-COMMERCIAL USE LIMITATION

If you use any part of the Site in breach of these Terms of Use, your right to use the Site will cease immediately and you must, at ERL’s option, return or destroy any copies of materials you have accessed through the Site.

The Site may contain links to external websites operated by third parties. These links are provided for your convenience only. ERL has no control over the content of such websites and accepts no responsibility for their them. The inclusion of any link does not imply ERL’s endorsement of the linked website, its content, or any association with its operators.

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of the Site, you warrant that you will not use the Site for any purpose that is unlawful, unethical, or prohibited by these Terms of Use. You further warrant that you will not engage in any form of data mining, scraping, harvesting, or similar data extraction methods.

While ERL has taken reasonable care in preparing the content of this Site to ensure the information is accurate and up to date, the information, products and services included on the Site may occasionally include inaccuracies or typographical errors. As such, ERL makes no representations about the suitability, reliability, timeliness, and accuracy of the information, products, services and related graphics contained on the Site for any purpose. All such information, products, services and related graphics are provided “as is” without warranty of any kind including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property rights. In particular:

all photographs and computer-generated graphics are produced from an artistic viewpoint and are for identification and illustrative purposes only and may not accurately represent the final product or setting;

If you are dissatisfied with any part of the Site, or these Terms of Use, your sole and exclusive remedy, except as expressly provided otherwise, is to stop using the Site.

REVIEWS

If you submit a review and/or testimonial through Google Reviews (or any other applicable review website), you agree to assign all copyright in such review and/or testimonial to ERL so that ERL can publish your review and/or testimonial on any Site. Please note ERL will identify you as the provider of the review and/or testimonial unless you notify ERL in writing otherwise.

In compliance with the Digital Markets, Competition and Consumers Act 2024, ERL confirms that all testimonials and reviews published on the Site are genuine and reflect the honest experience of their customers. No testimonials or reviews are incentivised, fabricated, or removed for reasons other than to ensure accuracy and compliance with applicable laws. ERL does not offer any rewards or compensation for reviews, and ERL is committed to transparency and authenticity in all customer feedback.

ACCESS RESTRICTION

ERL reserves the right in its sole discretion to deny to any user access to all or any part of the Site without notice.

MODIFICATION OF THESE TERMS AND CONDITIONS

ERL reserves the right to change the terms under which the Site is offered from time to time. Every time you wish to use the Site, please check these Terms of Use to ensure you understand the terms that apply at that time. These Terms of Use were most recently updated in April 2025.

MODIFICATION OF THE SITE

ERL reserves the right to make updates to and change the Site from time to time to reflect changes to ERL’s services, their users’ needs and their business priorities. ERL does not guarantee that the Site, or any content on it, will always be available or be uninterrupted.

ERL IS NOT RESPONSIBLE FOR VIRUSES

ERL does not guarantee that the Site will be secure or free from bugs or viruses and you should ensure that you have effective virus protection software in place.

You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attack the Site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. ERL will report any such breach to the relevant law enforcement authorities and ERL will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site.

GENERAL
These Terms of Use are governed by English law. You irrevocably submit to the exclusive jurisdiction of the English courts. Use of the Site is not authorised in any jurisdiction that does not give effect to all provisions of these Terms of Use, including without limitation this paragraph.

The Site is intended for use by residents of the United Kingdom (“UK”) and those intending to buy property in the UK. Without prejudice to anything in these Terms of Use, ERL does not represent that content available on or through the Site is appropriate for use or available in other locations and therefore ERL accepts no liability for any loss caused by use of the Site by anyone else residing outside of the UK. If you choose to access the Site from outside of the UK, you do so at your own risk.
